Thanks Alan - my mistake - I didn't realise the 892 was just dependent
on the Sponsorship from the State and not a requirement that the
business operate in a Regional area - so I should have compared 850 with
892 and not 890.
Here is the correct comparison for any 457ie holders out there:
Assuming you can get the State Sponsorship when operating a company in
PErth Metro (and the SBDC in Perth are very open to this at the moment):
845 requires you to:
have been in Australia for at least 9 months of the 12 month period
immediately before the 845 visa was lodged
have had an "ownership interest" in a main business(s) throughout the 18
month period immediately before the 845 was lodged
have had net personal and business assets inside Australia throughout
the 12 month period immediately before the 845 was lodged, of at
least A$250K
have had net assets in the main business(s) throughout the 12 month
period immediately before the 845 was lodged, of at least A$100K
have a score of at least 105 under the Business Skills points test –
the main requirement being a turnover of at least A$200K (or exports to
the value of A$100K) and employing 3 full-time equivalent employees (who
are not members of your family unit) throughout the 12 month period
immediately before the 845 was lodged. I will assume you can get the
105 points without having to increase the amount of net business and
personal assets in Australia.
For the 892 visa, you are required to:
have had an "ownership interest" in a main business(s) throughout the 2
year period immediately before the 892 was lodged
Unless the SBDC in Perth determine you have exceptional circumstances
you need to meet at least 2 for the following 3 throughout the 12 month
period immediately before the 892 is lodged:
A Have 1 or more equivalent full-time employees
B Have had net personal and business assets inside Australia of at
least A$250K
C Have had net assets in the main business(s) of at least A$75K
SUMMARY OF DIFFERENCES BETWEEN 845 AND 892:
892 does not require you to be physically in Australia for at least 9
months in the previous 12 months.
892 requires an “ownership interest” in a main business for 6 months
more than the 845.
892 has reduced required net assets in business, same total assets and
less employees - and only requies 2 out of these three ( and sometimes
one or none if the Sponsoring State find you have exceptional
circumstances.)
So unless you meet 845 criteria and can therefore apply for the
permanent visa 6 months ahead of the 892, the 892 looks to be by far the
easier but is dependent on the State Sponsorship.
