OK I see the problem.

If your ex has access rights the dept will be wary. By far the best way
is to get him to agree. However it appears that may not be an option.

Re the over 18 thing, If your under 18 your presumed to be dependent. If
your over 18 the presumption shifts the other way. However, if your in
full time study and totally depenent on your parents it shouldn't be a
problem.
