They are now talking about a 4 year rule, but the legislation may not
now be in force until 1 July 2007. The Bill has passed the House of
Representatives but awaits Senate consideration.
Existing permanent residents at Commencement Day will be assessed under
old rules provided application is made within 3 years of Commencement.
The definition of "permanent resident" in the Citizenship Bill is
different to that of the Migration Act. We have not yet seen whether
DIMA's interpretation includes those with permanent visas granted but
not validated. However the interpretation they give will have to be
consistent with the law and could be challenged legally if it is not.
