Applying for Work & Holiday (subclass 462) after filing for Permanent Residency Visa? Posted on: Mon, 12 May 2008 05:44:06 +0000


Hi all!

First off, this site has provided me with a wealth of knowledge and I
am very grateful for it. Here is my situation.

I am 24 year old US Citizen with a 4 year business degree from the
United States. I do not have a criminal record and I have no medical
conditions. I have applied for my skill assessment through CPA
Australia as an Accountant (2211-11) and I'm awaiting my results.
Assuming I get an OK, I will then proceed to get regional sponsorship
through South Australia since my destination city is Adelaide (and will
hopefully speed up the DIAC process). Assuming I get an OK from the
government of South Australia, I will then apply for subclass 176
(Sponsored Migrant Visa) with DIAC. Now here is my question:

During this lengthy process with DIAC, can I apply for a Work and
Holiday visa (subclass 462) and take up temporary/seasonal work while
they are processing my subclass 176 application? From what I've read,
the subclass 462 visa processing time is extremely quick (couple of
days). I have relatives back in the states at my mailing address who
will inform me of any correspondence from DIAC and I will undertake a
medical/police check before I leave for Australia (if I can get a
subclass 462 visa) so that when they are requested, I can have them
forwarded to DIAC.

According to the immi.gov.au website regarding subclass 176, "Unless
you are an eligible New Zealand citizen, you and any secondary
applicants included in your application, *must be outside Australia* at
the time that a decision is made on your application. "

This makes it sound as though I could be in Australia on a subclass 462
visa and so long as I am out of the country when the subclass 176
decision is made, I have done nothing wrong. Does anyone have any
experience with this?

The site further stipulates that, "If you need to be outside Australia
for your visa to be granted and you have not already departed Australia,
the letter will specify the time period you...have to depart Australia.
If you do not depart within this time period, your application may be
refused."

Any help would be greatly appreciated!
