Subject: Removing children from NZ to Aussie Posted on: Sun, 7 Sep 2008 11:57:30 +0000

Hi

My husband and I have decided to move to Melbourne next year. Our
reasons for moving are 1) Move to join family members in Melbourne. 2)
Better job opportunity.

However I have three children to my first husband, of which two aged 8
& 10 will be moving with us. I have custody (day to day care) of them
and my ex husband has contact/ access. There is also a Protection
Order against him to protect my children and I. We have been seperated
for 6 years now and he lives 1 1/2 hours away. He has never kept to his
access or played much of an active role as a father. I rang him this
evening to discuss the move with him and he basically verbally abused
me and hung up on me.

Does anyone know or can they please suggest what I need to do to remove
my children from NZ to live in Australia? Do I need to apply to courts
or am I within my rights to just take them.

Thanks,
Cheryl:
