Subject: Foreign divorce question for experts (Andrew, Jim, ect) Posted on: Thu, 2 Oct 2003 20:40:20 +0000 (UTC)

I was divorced at the end of 2002 in the United States. Both my ex and
I are natural born residence of the U.S. and had never lived outside
of the U.S.

Now, I have to get my divorce recognized by Ontario, but I'm
wondering, what is considered "jurisdiction" in relation to Canada
divorce law?
In my state, each party must only live in that state for six months
prior to divorcing.
Now, my ex husband had lived in the state I divorced in for years
prior to the divorce. So had I, but I left the state for three months
after our seperation to stay with relatives in another state, trying
to decide if I should move out of state. I even got my drivers license
in that state and then I left about a month later, coming back to my
home state. Then, about seven months later, we started our no-fault
divorce (legal in my state, just marriage breakdown)
Question, now, since we had no property, children or even a house we
bought together, our divorce was filed outside of the county in which
we lived, but was still filed within my state. What does ontario
consider jurisdiction?? I'm worried this won't be recognized in
Ontario. Was my leaving the state and getting my license relinquishing
my residency?
I hope this makes sense, sorry if it's rambling.
Thanks,
H.
