Impossible - the warning (box with bold text) about new law was posted on
the CIC home page since November 2001, also information and links about new
law coming into force on June 2002 including fact that new rules will apply
to cases received after November 2001 (later revised to after Dec 31 2001)
were there for everyone willing to see. Same in visa posts. You didn't need
to read newsgroups to know about it - paying attention to CIC website was
enough.
Why those cases are behind applications filed later? I already explained
reasons - lack of clear rules at early stages (those cases couldn't be
processed at all until rules were published and law implemented on June 28)
and later court challenges technically freezing processing of those cases
were the main reasons for delays.
In the period when Jan - July 2002 apps were frozen life had to go on and
cases submitted after June 28 in full compliance with new rules were
processed. You wanted them to be frozen as well and processing officers
having nothing to do?
And yes, those cases are being now processed like apps submitted after June
28 - but the problem is that all those cases needed (and many may still
need) to be updated to new rules, forms and documents requirements. It takes
time to assess them, to send requests for updates, receive them, re-assess,
etc.
I had many clients who have filed on their own in same period as you but
decided to hire me to update their packages as soon as they realized that
update is what is needed. All of them already have their visas. Many who
didn't hire me or any other practitioner but read about it in various
newsgroups or realized the need on their own have also updated their
applications ASAP and got their visas. Those who are still left behind are
applicants who didn't update their applications soon enough or not at all
yet.
It is your responsibility to make sure that application complies with rules
it is processed under. If you wait for request (or invitation) to update
your file then you are again behind those who applied after you but updated
their files sooner than you. I hope that it makes sense to you and that
you'll see that it is all up to you to not be left behind. Officers have
their hands full all the time.
