Subject: Pls clarify regarding Spousal sponsorship... Posted on: Tue, 3 Jul 2007 02:00:14 +0000 (UTC)

Hi Experts & Friends,

I'm a permanent resident here in Canada & 'am in the process of
sponsoring my wife from India, who is a Indian National, settled in
India, never married or in common law & with no children. I have the
following questions that I need to get clarified, pls!

1. In the form "Application to Sponsor and Undertaking" [IMM 1344A],
question #6 (b) & (c) I was wondering what will be my selection. My
wife is an Indian National, being born & living in India forever, so
the address in 6 (a) is an Indian address. As per my understanding,
answers to 6 (b) & (c) should be 'Not Applicable' in her case, but
there is no such option mentioned in the form. How do I handle this
question & make it clear that her Visa needs to be processed in
India??

2. In the form "Application for Permanent Residence" [IMM 0008
GENERIC], in the 'Details of Family Members' (page 2) does she need to
write about her Mother, Father, Brother, Sister & add their pictures
as Family Members, or does "Family Member" implies only to spouse/
common law & children? As she was never married before or has/had
common law or children, does she leave the entire page 2 as 'Not
Applicable'? or, does she have to enter MY details (as being her
spouse, sponsoring her)? Pls advise as I'm kinda confused!

3. Is it mandatory to provide a photocopy of her Birth Certificate?
The point 6 in Check-list, in Part 'C', under 'India' (http://
cic.gc.ca/english/pdf/kits/guides/3904E.PDF) says:
<<6 IDENTITY AND CIVIL STATUS DOCUMENTS
Provide birth certificates, baptismal certificates or other official
document confirming relationship
(including all pages of Household Registries) for you and each of your
family members.....>>

Doesn't it sound that the Birth Certificate it is asked for
'confirming relationship' between children & parents, & thus not
mandatory for a Spousal appliation?? My wife is not in possession of
her birth certifacate, thus I want to avoid that (but she can surely
enclose other Government Age Proof documents, if needed)

I would much appreciate if you may take a time to advise me on these
issues!

Looking forward to your prompt response,

Best regards,

- Dhrubo
