Subject: Canadian Citizenship-Exceptional Case Posted on: Wed, 29 Oct 2008 17:00:12 +0000 (UTC)

Dear Experts,

My situation is a little special, I was wondering if any of you can
help me in such situation.I immigrated to Canada in April 2006, so in
April 2009 I will complete 3 years. I joined a company in Canada who
is dealing with software implementation all over the world. However,
due to my work, I have spent a lot of time traveling so I am really
far from having 1095 days in Canada. Even if i spend the entire 4th
year in Canada, I will not come to 1095 days. However, this will have
a huge impact on my job (and income!), so it's out of question. 3
years in Canada out of 4, which is like spending 75% of the time here,
is impossible to me since i spend around 50-60% of my time traveling.
I work for a Canadian company but spend a lot of time with the clients
abroad. I am on Canadian payroll all the time, pay my taxes in Canada,
invest money in RRSP, rented an apartment in Canada where my wife is
living as we dont have any kids. She lived in Canada all the time and
after completion of every assignment I go back to Canada to spend time
with my family.

I've heard from some people that I can apply for citizenship because I
only travel for business, but also because none of these trips was to
my country of origin, and because they are spread everywhere in the
Americas, Africa and Europe. I think this is supposed to prove that I
have stronger ties to Canada than to anywhere else. My physical
presence in Canada out of 3 years and would comes to around 675 days.
If I apply after 4 years my physical days in Canada could be around
800 to 850 days but still less than 1095 days.

I would like to know do I stand a chance in getting my citizenship.
Another thing should I apply after completion of 3 years or should I
apply after completion of 4 years in both the cases my physical
presence will be short then required. So, I was wondering why I should
not apply after completion of 3 years.

My wife will going to apply for Citizenship after completion of 3
years as she has required 1095 days physical presence in Canada. She
will apply separately as if she apply with me her case would also be
delayed.

I would appreciate if any expert could help me in my case. I would
appreciate if anyone refer me to an experienced lawyer who deals with
such kind of cases would be hightly appreciated.

Sorry for long post..................

Regards
Ahmed
