Subject: I-130 revocation due to death of petitioner Posted on: Thu, 15 Apr 2004 18:05:00 +0000 (UTC)

Does anyone have an answer to this question.
A United States citizen father files an I-130 for his son/daughter.
Just before the Immigrant Visa number becomes available ( about 6
months), the citizen father dies.
Does this mean that there is no hope for that son/daughter to get an
immigrant Visa based on that same I –130 filed by the dead citizen
father?
The mother is still alive however and she is a citizen. Can there be a
substitution of the petitioner since the mother of the son/daughter is
also a US citizen which would allow the son/ daughter to immigrate
using the same I -130 instead of having the citizen mother file a New
I-130 and have the child wait again.
