I am an USC.
My wife is conditional GC holder, she is a resident since 12/21/01. (Date on
GC)
Her GC Expires date is 12/21/03 (Date on GC)
We filed I751 on time.
She received from INS "Notice of Action" dated 10/01/2003 stating:
"Your alien card is extended one year employment & travel authorized.
Processing your form will require a minimum of 330 days. If you have not
heard from us within 11 months, then you may contact this office." (This is
exactly from the document)
I have to travel for business to Europe from May 17, 2004 to October 7,
2004. It is my desire to travel with my wife. My wife is afraid that INS
calculates 12 months of extension from the day of "Notice of Action",
therefore we should arrive to USA before 10/01/04.
If I understand their notice right, than GC is extended from 12/21/03 to
12/21/04.
QUESTIONS:
1. Am I right?
2. Should I adjust trip?
