Subject: F-1 overstay and I-140 , I-485 Posted on: Thu, 3 Jun 2004 07:13:27 +0000 (UTC)

I have overstayed my F-1 for 2 years now, and my work permit which I
applied and received when I graduated from college (EAD through
optional practical training), has expired too. but I have the "D/S"
on my I-94.

I have an employer who's willing to sponsor me permanent residence
through the labor certification program, not the H-1B program.

Would there be any problems for me if my employer proceeded with the
labor certification, I-140 and I-485?

Since I have F-1 status and already have been issued a work permit
after college, would that be a problem for me too?
