He's almost certainly illegally present and subject to a ban from
re-entry for 10 years. The validity period of the visa is irrelevant
here. A visa is a document that allows him to go to a USA Port of
Entry and ask to be admitted. If it's a 10-year visa, that means
that he's entitled to ask to be admitted any time during those
10 years. How long he gets admitted for is an entirely different
matter, decided by the immigration inspector at the Port of Entry.
For tourist visas, the admission period is usually 6 months,
sometimes less. The date by which he should have left the USA is
written on the white I-94 form that he received when admitted.
I believe there are sometimes amnesties that allow such illegal
immigrants to sort out their status, but I don't know the details. |
