Universities are to enforce the law (or legislation) that allows I-130
pending students as residents for tuition fee purpose. Hence, instate
tuition fees. Talk with the registrat of the university or college. Do
not ask whether such is the case. Inform them that you know about
such provision and ask for your entitlement.
In your husband's case, since he can file I-485 at the same time you
file Alien petitioning (i-130), he will also have I-485 application
receipt. It has long been established that those with I-485 receipt
are residents, may be more than just for the tuition fees purposes.
About worrying, I have learned that it is better to use that energy
you lose in worrying to try one thing after another. In the end, you
will succeed, however many obstacles you face. This immigration
process is complicated enough even for those who are in immigrant
