This makes some sense... for the reason you state.
If both parties are from outside the US and travelling to the US to get
married, do they still do this? (Not that many Canadians I know would go
to PA to get married, some might go to Vegas though to combine a cheap
wedding and honeymoon. Lots of people I know want a honeymoon, and Vegas
is affordable for Canadians, family pressures us to marry and have this
great big party and expensive celebration).
Just a thought... I suppose it's possible of both parties can prove they
are from another country with valid status, the courthouse may permit them
to marry. After all, if two VWP people get married to each other, this
will not affect their status as they're both leaving within 90 days.
