Since this is a family-based application, I don't think that applies. I'm
assuming an I-130 was filed for the OP and he's waiting to be able to file
I-485, so he's legitimately concerned that once his H1B expires, he'll no
longer have a legal status, which is true, unless he can find another status
to switch to.
