I've been an F-1 graduate student in the US for the last six years.
Prior to my graduate studies in the US, I was an undergraduate student
in Canada for four years. Every summer while in Canada (three in all), I
would travel to the US to work as a camp counselor on a J-1 visa for a
couple of months. During my first summer in the US while a student in
Canada, I was subject to the 212(e) two-year foreign residency
requirement. (During the other two summers, I was NOT subject to that
requirement.) I went only for short visits to my home country (Russia)
during my studies in the US and didn't do so at all while in Canada.
MY QUESTION IS THIS: HAVE I ALREADY FULFILLED MY TWO-YEAR FOREIGN
RESIDENCY REQUIREMENT OR NOT? The application for the waiver states that
the requirement can be met via "an aggregate of two years in the home
country or last foreign residence" but does not explicate whether that
stay has to be uninterrupted (i.e. not involving trips to the US) and
whether "last foreign residence" means permanent residence or residence
per se (e.g. in my case as a student in Canada).
I would appreciate very much whatever advice anyone can give on
this matter.
