Subject: H1B worker filing marriage based GC, do I need EAD and Advance Parole Posted on: Mon, 16 May 2005 22:51:48 +0000 (UTC)

I am currently on H1B. My husband is a US citizen, so we'll file I-130
and I-485 sometime soon. I don't plan to change employer for quite a
while. However, my H1B will expire next year (I am hitting my 6 year
max in early 2006). We don't plan to travel overseas until mid 2006.

Can I assume that I wouldn't need to file for EAD and Advance Parole,
when we file I-130 and I-485? I am assuming that the conditional GC
will be issued in about six months after we submit the docs, and that
when the conditional GC is issued I can use it for work and traveling,
without need for EAD and Advance Parole. We live in Silicon Valley bay
area, our local service centre is San Jose.
