HELP!!! TN-1 for Canadian working in China Posted on: Mon, 27 Jun 2005 06:26:23 +0000 (UTC)

My wife and I were both born in China. I became a Canadian citizen in
2002, and she became a US citizen in 1995. We got married in 2001 in
New Jersey, and she has been living in Canada with me since then, and
later obtained her Canadian permanent residency. We have a
three-year-old daughter, and are expecting our 2nd baby. My daughter
has dual citizenship.

In 2003 I finished my Ph.D. in Electrical and Computer Engineering in
Canada, and moved to China with my family in 2004 to work for a US
telecom company. Now I have been offered a DSP engineer's position
by a US startup company based in San Diego. They want me to join them
as soon as possible.

As a Canadian currently working in China, and married to an American
citizen, I am really confused. Please help me on the following
questions:

1. Can I fly directly from China to the US, and obtain the TN status at
the airport? Or do I need to go back to Canada first, just to be on
the safe side? Would the fact that I am working in China cause any
problem?

2. Does DSP engineer qualify for the NAFTA job?

3. I only have a photocopy of my degree certificate with me. Do they
need the original? I do have a recent academic journal which has one
of my publications and my biography (including my portrait, and the
date I got my Ph.D. etc.), would that suffice?

4. Would they ask about my family, and if so, would the fact that my
family are US citizens jeopardize my TN status? I intend to go to
California first on my own.

5. If, for some reason my TN status got rejected, is there any other
way for me to start working in the US asap? How long would it take for
my wife to sponsor me for a green card from China? What about I enter
the US as a visitor first, and then change my status later?
