I will really apprecite all or any help in this if you can answer all
or some of the questions that I have asked below. I am in a very
difficult situation right now and me and my tiny family need guidance
or advice in the form of your valuable opinion. Thanks in advance. Here
is my current situation in USA:
- I had elapsed from the payroll of my previous company for three
months while working on their H-1B visa
- I then got another job through another employer who had applied for
my H1B sponsorship.
- My H1B got and RFE (Request for Evidence) instead of getting approved
- The docs demanded in RFE were proof of maintaining valid
non-immigrant status at the time of filing the h1b petition, and lots
of tax, employment contract documents from my employer (who has
sponsored many successful H1B employees in the past).
- Our lawyer replied the RFE questions supplying documental proof as
requested in RFE.
- The petition for my H1B sponsorship got "denied" within two weeks
(since it was a premium processing fee case).
- Now the objection is discrepency in dates of the employment contracts
and the start date of employment.
- Folks, I want to ask: Is there any chance of the approval of my H1B
petition now when I appeal the denial of the H1B?
- How and why could have this happened to me?
- How many days do I have to leave US?
- I have applied for Canadian Immigration which is expected to complete
soon, is that all time wasted or can I sit here and wait for that to be
approved (since I have a valid H1b visa stamp in my passport)?
