Hi all,

I have a question for a friend who got laid off while on H1, about 2
months
ago.

For that previous job he got the H1 while in the US, but he had to
leave
the US and reenter on a fresh visa which he got from the US
Consulate abroad...

He has managed to find another job but the attorney has advised him the
following:

1) Since he is out of status, Leave the US before they file for new H1.

2) Then once he gets new H1 approval, they'll mail it to him outside the
US and then he re-enters on the previous company's visa..

My question is can he do that?
