Green card, or greeen form? Either one shouldn't be held against you.
I still don't know if you need to refile. Ask the lawyer if it would be
better to depart/seek entry as an LPR, explain the situation at the port
of entry, and see what happens. They may or may not set you up to see
an immigration judge. If they set you up, you'll be paroled into the US
for the hearing. If they decide not to set you up because the judge
will likely let you keep the card, then the problem is solved. They
could defer the inspection which wouldn't be a big deal. They may feel
it is a waste of time, and money to try to take the card away when the
relationship to the US citizen exists. Why take the card when you can
just file for another. It would be a waste of resources. Of course,
I'm not a lawyer, but the lawyer may just want to use the method that
costs you the most money.
