Hello:
An engineer and his parents and brother and sister immigrated into USA
legally. But a few weeks after they got their Green Card they returned
to their home country. In their home country they have worked and paid
taxes. They did not return their Green Card to US authorities when they
returned to their home country. They have never filed an annual
personal income tax in the US. Six years later the whole family entered
USA with their Green Card through the US/Canadian border. They knew
that there they would not face much questioning. Now they are living
and working in USA for five years. The parents have obtained the US
citizenship meanwhile.
Recently, this family had a dispute with someone who knows the family's
background very well. The person might report the family's case to INS.
What could the family expect from US authorities? Deportation? 5 or 10
year ban from entering USA?
In USA the family has never lived from social security and it has never
been a burden for the US welfare system. The son is working as an
engineer and USA needs engineers. They have bought several houses.
Nevertheless, they have entered USA with their Green Card which
otherwise would have been confiscated when the US officer at the US
border would have noticed that they were out of the country for several
years and that they have never filed personal income tax annually.
Moreover, the parents obtained the US citizenship based on lies because
they told US authorities that they never left US ground since they
immigrated into the country.
The family has earned lots of money since they are in USA and they
could afford a very good immigration lawyer. But would this help them
from deportation and a ban?
