Presuming this person left the U.S. prior to the expiration of the I-94,
and that he or she plans to eventually return to the U.S., the person
should begin accumulating evidence that he or she timely left the U.S.
in order to avoid an allegation of overstaying. The person should retain
any travel or flight itineraries, and any other evidence proving
departure from the U.S. Documentation evidencing activity in the
person’s home country from the time period immediately after the
person left the U.S. would also be helpful. For example, credit card
receipts, a letter from an employer stating that the person returned to
work, or payments of utilities, etc.
