I married a US serviceman in the UK in 2000, we went to Japan and then to
the US, I had one child when we met and we had two together. I filed my
I751( remove conditions) in October of 03 and received a letter in Feb of 05
saying that I could call to schedule an interview. However I had recently
left my husband because of domestic violence and child abuse, I was trying
to start over from scratch with my family and could not make an 800 mile
round trip to my local sub office at that time. He is still being
investigated by the fed government for the child abuse. I called an
immigration officer and explained my situation, I have court orders in place
denying him access to the children and an injunction, I have sole legal and
physical custody through the courts but am not yet divorced. I was told by
the officer that if I went to the sub office with all the documents, proof
of bona fide marriage, abuse etc that they would stamp my passport until
such time as I could re arrange the interview. I did this and was told at
the sub office that my case was closed on Jan 10th 06 and my latest address
was not in the system, that is not true as I have a letter from them
confirming that the change was made. They said that they could not tell me
why it was closed because they don't keep my file there. I was told that I
need to leave the country ASAP because if they take deportation proceedings
I will go to Jail and lose custody of my children. Well I am sure I have a
case to fight and I don't believe they can do this, I am happy to go back to
the UK as I have and my kids have put up with enough since we have been here
and I am worn out with it all. one of our children was born in Japan and has
a US consulate certificate of birth abroad, the British Consulate said it
was okay to use this for a Brit passport as I am a Brit citizen. What I want
to know is this. I don't want to come back here, if I leave with my kids,
all on Brit passports am I doing anything illegal? I do have sole legal
custody as I have said and they are all entitled to British Citizenship.
Will I get stopped at the Airport on the way out for any reason? do I just
show them that my green card ran out and show them my court order and all
the documents. I have had nothing in writing from the INS. I had to give up
everything to be with this man and will have to give up everything to return
to the UK as I don't have the funds to move my stuff back and he has not
been paying the support that was ordered by the court back in June of 05, he
has been paying less than half of the court ordered amount. I was also told
that I would not be allowed to file my 2005 tax return, that doesn't make
any sense, if they didn't close my case until 06, why cant I claim for the
work I did to support my kids in 2005? Sorry it's long, but hopefully
someone has some knowledge in these areas. Thanks in advance.
