Hi:
A fair question. As a general rule, the L-2 need not be traveling with
the L-1. It may be possible where the L-1 is in the US working and the
L-2 actually spends most of the time outside of the US -- no problem.
Where I HAVE seen problems arise is where the L-1 spends most of the
time outside of the US [which can be consistent with L-1 status when you
think about it] and the L-2 spends nearly all of the time inside of the
US. The law on the L-2 is fuzzy on that, but I've been able to
favorably resolve it when the issue has come up.
