Hi,

A friend of mine works for a company that was acquired a while back
by another company. The old company had filed for Labor Certificate
for him in the traditional way (non-RIR) about 2 years ago. He does
not think the file was amended about the acquisition of the old
company, and the fact that the new company owns the file. Can
the new company start the PERM process for him under his own
name without withdrawing the non-RIR filed filed by the acquired
company?

He is in the 6th year of his H1-B visa. If the non-RIR LC file is
withdrawn his H1B extensions beyond the 6th year will be in jeopardy.
