Visa 4 non-resident partner of H1B->GC Posted on: Mon, 26 Jun 2006 07:51:45 +0000

Hi all

I usually post on other parts of britishexpats, but need a little help
in this area. I have trawled previous posts and looked at the FAQs, but
still have questions. Hope that you can help. :)

My current situation is:

Full-time UK student (medical degree, completed 3/5yrs). I visit USA on
VWP.
UK partner of 7 yrs has H1B, just been renewed. His company will
sponsor GC.

We intend to marry at some stage, it's not a high priority. Our future
situation MAY involve me relocating to the US (versus he coming back to
UK), in the capacity of undertaking a medical training program ie being
a doctor. I do NOT want to have to do this using a J1 visa (way too
difficult to get a position as you are competing with half of the
world!) nor if possible a H1b (for the same reasons).

My questions are:
1 Can a fiancee/wife who is not living in the US, nor who has any type
of US visa, be part of her partner's GC application? (I have no SSN)

2 If answer to 1 is yes, would there be a residency requirement during
processing?

3 If answer to 1 is yes, how could the requirement of a GC holder to
reside in the country/have on-going ties be met whilst I am being
educated in the UK?

4 If answer is 1 is no, then what options would be open to me to be with
my "hubby" if he is a GC holder, and when could I work? This in the
context of me visiting over the next 2 or 3 yrs, then living there.

Thanks so much
