Over stayed - left and question on return visit Posted on: Sat, 23 Sep 2006 20:43:58 -0600

Summer of 2000 I went to the U.S. and married an American citizen. I
never filed any paper work, never tried to seek a job as I had an
independant income. Fall of 2002 we loaded a U-Haul and returned to my
country of Canada. At the border my wife had business to attend to at
the U.S. side and they asked my status. I told them I was CDN and in
the course of conversation I had over stayed. They said I had to leave
the country and I simply pointed at the U-Haul and said wrap up her
business and we're gone. I didn't sign any paper work, they neve asked
for any I.D. but of course they got my licence number [American
plates, swapped out for CDN tags the next week].

So I wasn't swept up and "deported" by the INS but I imagine there may
be a file with my name on it somewhere. My question - this coming
summer there is a family event requiring my wife to return to attend.
Its been four, well - five years next summer, should I even bother to
gas up the car or just put her on a plane? She's filed and legal in
Canada.
