If he was in overstay at any point during his stay in the USA, it is
probably not wise for him to leave the USA until he gets his green card.
I actually don't quite follow the process you are going through. When
you got married, you were filing for his AOS, right? That means you
were submitting the I-130 and I-485 along with all other forms and
backup together. So why are you now only concerned with the I-130,
and why would it take 3 years for it to process? That seems awfully
long to me.
As part of the AOS package, did you include I-765 for his work
authorization? Did you include form I-131 for AP so he can travel? Of
course again if he's overstayed in the past, the AP wouldn't be any good
anyway...just curious if it's been applied for.
