So someone from immigration just walked up to your husband on the street
and said "you're out of status, come with us?" That just doesn't make
sense to me. Unless someone was specifically keeping track of people
with student visas who did not renew the visa, and then finding them and
coming to their homes to bring them to detention. Who knows.

If you don't want to get a new attorney, I guess all you can do is
follow the I-130 through its course. At some point perhaps you can ask
the judge what to do...but if I were you, I'd have at least a 1-time
consultation with another attorney. And forget about traveling overseas
until this is all settled and he has his green card.
