The safest thing to do, is apply for an I-192 waiver. The waiver will
either be granted or denied... Either way, you know your answer. I
doubt anyone here can tell you if he's barred. The first question is,
by how long did he overstay? What are the circumstances surrounding
his overstay? If he dropped out, he overstays if he is in the US one
day past the date he dropped out. if he overstayed by 180 days or
more, it's a three year bar automatically. If it's by 1 year or more,
10 year bar. So if he did overstay by that long, you know the answer.
