Subject: Now that I have my green card, can I start my own business? Posted on: Tue, 10 Apr 2007 18:45:28 +0000 (UTC)

Hi and sorry if this question has been asked before, but I have seen
different replies and I want to be 100% sure...

I received my green card through sponsorship from my current employer.
The salary for my GC application was $55,000. Over the years, I have
received promotions and my current salary is $70,000 plus a bonus of
approx. $5,000 - $15,000.

Now that I have had the GC for approx. 2 years and have worked for the
employer 7 years, I feel it is time to move on as I am not being
adequately compensated for the work I do. I have consequently been
looking around and i have found a foreign company that wants to "hire"
me as their north american sales coordinator. They say I would have to
start my own business, and they would then pay me a fixed amount every
year plus commission. So I would not be their direct employee and
rather work for myself. The area or industry I work in would be the
same as before. I really don't see any danger of losing my GC in doing
this, because

a) I have had the GC for over 2 years so it does not look like I just
used my employer to get it
b) I am staying in the same field (I would actually be a competitor to
the company i work for now)

The only real concern I have is that I will be making quite a bit more
money than with my current employer and tjhe amount that was used for
my GC application ($100,000+ vs. $55,000) and I saw someone mentioning
that your income would have to be "comparable", but if I would have my
own company, so is this still a concern? The other question is can I
just start my own business and would this be allowable?

Thanks a bunch
