Well then in that case I assume your reasoning is bogus that a person
who overstays the visa
and is married to a US citizen cannot adjust status based on
immigration fraud ie - when
applying for the non immigrant visa the person did not tell the
consular officer that the person
wants to immigrate to the United States.
Also I doubt that INS will look very harsh on a person who got the
F-1, actually studied in the US and
then when the spouse became a US citizen immigrated to the US.
