To clarify, the two consquences of the captain's poor choice were based on
two different standards.

He was fired by Celebrity because they have a Zero Tolerance policy with
regard to drinking within 8 hours of duty. The reported smell of alcohol on
his breath was enough to trigger termination of employment, although I
imagine Celebrity relied on additional corroborating evidence.

He is being charged with a criminal offense because the federal maritime
limit is .04 BAC.

The media reports consistently reflect his BAC was more than .08. All you
have to do is Google for some BAC drink tables, and you will see this
captain had to consume quite a lot of alcohol...not just a couple of beers
or glasses of wine...to register .08+ regardless of his weight, number of
hours, meals consumed, etc.
