The whole problem was the weather. There was supposed to be a window
of opportunity to fly that never happened. The snow and sleet here in
the NY area was was supposed to change over to rain but it didn't. The
pilot of the plane is the law of the aircraft. The pilot was in
constant contact with the tower and JetBlue headquarters. If JetBlue
choose to "roll up" stairs and passengers fell (due to ice) JetBlue
would be liable. Now it the passengers fell on the tarmack both JetBlue
and the Port Authority of NY would be liable. Once a plane returns to
the terminal they loose their place in line for departure. So had their
been a break in the weather that plane would have now been last to
depart. It was a crap shoot.
JetBlue really took a beating this week. But this is really rare.
I've sat on the tarmack at LaGuardia for 4 hours with no A/C in July on
USAIR. I know first hand its not fun-But weather delays happen. Now
lets look at those who were flying. Obviously every passenger on those
planes knew a storm (a bad storm) was coming. It had been in the news
for 3 days. So those passengers took their chances. They could have
rescheduled two days prior...either leaving before or after the storm.
To wait and board a plane in the middle of a snow and ice storm (that
was supposed to last 24 hours) is also a crap shoot. This is where a
Passenger Bill of RIghts would have helped.
