Seems that Carnival isn't refunding fuel surcharges for two reasons:

They had a clause in their brochure stating that they could impose them.

They got prior approval for the surcharges from Florida State Attorney
General Charlie Crist.

5 days after that opinion was given, HAL and Princess cruise lines each
donated $250,000 to the Florida Republican Party and Charlie Crist is now
Governor.

Ain't nothing dirty goin' on here!
