A less offensive method is to keep your left indicator flashing. Keep
your distance and hope he'll move over.
You have no right to be able to overtake. The person in front of you
is doing something wrong - you have no right to also break the law.

Both, depending on context.
Flashing lights is the same as using a horn; to alert other road
users to your presence. Overusing it to get people out of the way is
considered "aggravation".
There is a minimum distance you are expected to keep (related to
speed) -roughly the 2-second rule. I'm sure a resident German could
give the exact rules.
