There's plenty of case law on this
A tip is only mandatory if its stipulated on the menu
as that is the basis for the contract between diner and
restaurant.
Tips other than that may be customary but they are not
enforceable in law. I usually tip but I do recall one case
where the food and service were both so awful that I
made a point of seeking out the waiter and informing
him just why he wouldnt be getting a tip.
Now waiters will be assessed by the IRS as receiving
percentage of their income as tips but thats a quite
different issue.
